Scope

These terms apply to consumer purchases from Senior Phone. You can read and save them before ordering. Mandatory consumer rights always remain in force. Different arrangements apply only to the extent permitted by law.

Products and ordering

The product page shows the version, colour, price and included items. Before ordering, check your selected version and the information on SIM cards and network support. You can correct input errors before placing the final order. The final order button creates an obligation to pay. We confirm your order electronically and provide the applicable terms and withdrawal information in a form you can keep.

Prices and payment

Prices are shown in euros and include applicable VAT. Delivery charges and any other costs are shown before the final order. No additional paid products or services are added without your agreement. The price agreed at the time of ordering remains valid.

You can choose from the payment methods offered at checkout before placing the final order.

Delivery

We deliver to the agreed address in the countries listed in our delivery policy. Costs and delivery times are stated before ordering. If no other period is agreed, we deliver within 30 days. We inform you of delays. Your statutory rights for late or failed delivery, including cancellation and refunds where applicable, remain unaffected.

The risk of loss or damage remains with us until you or your designated recipient receive the product. The statutory exception for a carrier you choose that we did not offer remains applicable.

We deliver throughout the European Union. Delivery is €5 per order, including VAT. Read our delivery policy for dispatch and delivery information.

30 days to change your mind

You may withdraw from your purchase without giving a reason up to 30 days after the day you, or a person you designate other than the carrier, receive the product. If one order contains products delivered separately, this period starts when the last product is received.

Withdrawing from your purchase

Tell us before the deadline that you wish to cancel the purchase. Send a clear statement by email to info@senior-phone.com or by post to the address below. You may use the model cancellation form, but this is not compulsory. You do not need to give a reason, supply photos or obtain prior permission to withdraw.

Returning the product

Send the product back no later than 14 days after notifying us of your withdrawal. Sending it within that period is sufficient. Returns address: Nutel, Stationsmeester 53, 1704 AN Heerhugowaard, Netherlands.

When withdrawing, you pay the direct cost of returning the product to the Netherlands. Choose and pay a local postal service or another carrier in your country. Check their current rates first. We do not provide a free returns label for withdrawal and do not charge administration fees. If we supplied the wrong product or a defective product, we pay the necessary return costs.

Inspecting your phone

You may open the packaging and inspect and try the phone as necessary to establish its nature, characteristics and functioning, as you would in a shop. Opening the packaging alone does not remove your right to withdraw. For handling beyond what is necessary, we may deduct the resulting loss in value if we correctly informed you of your withdrawal rights beforehand.

Pack the phone carefully, in its original packaging where possible, with the supplied accessories. Missing original packaging alone is not a reason to refuse withdrawal. Remove your SIM card, memory card and personal data before returning it.

Refunds

After withdrawal, we refund you within 14 days using the same payment method, unless you expressly agree to another method at no cost. If you withdraw from the whole order, we also refund the standard outward delivery charge. Extra costs for a more expensive delivery option you chose are not refunded. For partial returns, the original delivery charge is not refunded to the extent that it would have been the same for the products you keep.

We may withhold the refund until we receive the product or you provide evidence of having sent it back, whichever occurs first. This does not apply if we offered to collect the product ourselves.

Statutory warranty

You are entitled to a product that conforms to the contract and meets reasonable expectations for normal use. For Dutch consumers, statutory warranty is not limited to a fixed period of one or two years. Any additional manufacturer warranty does not limit your statutory rights against us.

If the product does not conform, contact info@senior-phone.com with the model, purchase details and a description of the problem. For a valid warranty claim, we provide an appropriate remedy, such as repair or replacement, free of charge, within a reasonable time and without significant inconvenience. Where the law permits, you are entitled to a price reduction or cancellation of the contract. We pay necessary shipping costs for a valid claim.

Making a complaint

Email your complaint to info@senior-phone.com and tell us how to contact you. An order number helps us locate your purchase, but you may also prove your purchase in another way. Report a defect when you discover it. For Dutch consumers, notification within two months of discovery is always considered timely.

We will consider your complaint and keep you informed. Your right to bring a dispute before a competent court remains unaffected.

Applicable law

Dutch law applies to the contract. If you are a consumer living in another country where we direct our activities, this choice of law does not remove the protection of mandatory rules that would otherwise apply. These terms do not limit your statutory rights to bring proceedings before a competent court.

Version

The version provided with your purchase applies to that purchase. We do not subsequently change it to the detriment of your statutory rights.
